This specification corresponds to the contracting of the updated services offered by the Agency so that they can be offered, carried out and completed correctly in accordance with the provisions of current applicable legislation.
Access the services offered
The user/client accesses the services offered with full awareness of his/her actions and having read and accepted these General Terms and Conditions for the Contracting of Services. This access to the service can be done by contacting the Agency and its legal representatives only through the channels offered.
Nature of the services offered
The services offered by Agencia Cardiel&Books will be of a diverse nature, always related to the representation of authors, publishers and companies, the communication and creation of content, the management of industrial and copyright rights, as well as any other legally competent services to be offered by this company.
An information service for journalists is also offered, of an exclusive and free nature, which consists of the voluntary registration of the interested party by completing the forms enabled for such purposes (one in Spanish and another in English for non-Spanish-speaking journalists). The sole purpose of this service is to send information, press releases, announcements and other types of communications, in a privileged manner and in advance of other media not subscribed to this service, so that interested parties can prepare journalistic content, or publish all or part of the information sent, in the media for which they work in a verifiable and accredited manner.
Specific conditions of the services offered
The specific conditions and price of each of the services offered by the publisher will be duly informed to the user/client. However, the Agency will update the list of services offered to users/clients every calendar year between January 1 and March 31. Likewise, the Agency will issue within that interval, and on an annual basis, a price list valid until December 31 of that same year. Due to the usual uniqueness of the services offered (those that imply personalization, individual attention for each case, etc.), the final conditions offered to the user/client for each service and at each moment of its contracting will be subject to a budget with contract value in its simple acceptance or to a formal contract.
In the case of contracting services that require a formal contract in accordance with Commercial Law, such as agreements for the supply of content or the representation of literary works, authors and publishing companies, the specific conditions for each case will be duly informed, negotiated and, finally, reflected in the form of a contract in accordance with the applicable Law in force.
Conditions of information for Press Room

It is advisable that the interested party in registering for this service be aware of the following conditions that are specifically reflected in the Terms and Conditions:
1. By sending this form, the interested party is only requesting registration for the service. That is, they are exercising a request for acceptance that must be approved by Cardiel&Books Agency and its managers. Requesting registration for the information service for journalists does not generate any right to belong to and enjoy it.
2. Any request for registration for this service that is not made through the form provided (this form) will be considered rejected and, for this purpose, the Agency will remain silent. Only in exceptional cases, due to malfunctioning of the form provided for this purpose or other justifiable reasons, the Agency may register you for the service through other channels, as long as they comply with the requirements of the applicable legislation in force.
3. Your acceptance of the service and your definitive registration will be communicated to you by the Agency to the email address you have indicated. If you have not received a favourable response within this period, you can contact the Agency directly through the CONTACTO (Contact) tab on this website, where in the event of an error they will tell you how to correctly process the registration. If another 4 weeks pass after contacting the Agency and you do not receive a response, consider your application rejected.
4. Once you have been accepted into the service, contact will be maintained via emails that will depend on the Agency’s activity (they will not be regular). You may unsubscribe from the service by sending an email to agencia@cardielbooksagency.com, fully exercising the rights recognized to you in the L. O. 3/2018, on Data Protection (Spanish Data Protection Law published on the BOE journal).
5. This Agency reserves the right to refuse admission to those who, for the reasons and motivations that its managers deem appropriate, determine appropriate. In this case, the Agency will reject your application by remaining silent.
6. In the case of point 4, where the reason for refusal is due to a particular media outlet, the Agency will also reject your application by remaining silent.
7. If unpleasant or criminal situations occur during communications (e.g. insults, deliberately hostile attitude, failure to comply with the rules of coexistence, well-founded suspicion of industrial or general espionage, etc.), the Agency reserves the right to notify you of your forced withdrawal from this service. In such a situation, the affected person will not be entitled to receive any compensation of any kind.
8. In case of doubt about the veracity of the data provided, Agencia Cardiel&Books may request verification of your membership and activity as a journalist from third parties (employers, media outlets, etc.).
9. Cardiel&Books Agency reserves the right to modify, delete and expand these Conditions without prior notice.
10. The application for registration in this service, as well as your admission to it, implies the acceptance, with full and proven knowledge, of these Conditions, of the provisions of the Terms and Conditions and the Privacy and Data Protection Policy.
11. The interested party registered in the service may not alter the information contained in the communications sent to them, nor sell them to third parties, nor send them to companies and organizations that compete with them or that represent a danger to the activity of the Agency, its representatives and its partners and collaborators. The Agency will allow interested parties subscribed to the service to submit their own and original content for publication in the media for which they work or for which their work is carried out, provided that they respect the veracity and rigor of the original information sent. Cardiel&Books Agency may demand the removal of information that violates these conditions or which is attributed with malicious capacity, impact or attitude, from the content published by the interested party or from the interested party itself, which the interested party registered in the service agrees to abide by at the time they become aware of these Conditions and request registration in the same. In the event of persistence and/or failure to comply with this requirement, Cardiel&Books Agency may exercise the legal actions it deems appropriate in defense of the image, integrity, rights, business, profit or circumstance for which it is competent, whether its own, its representatives, partners and collaborators.
User legal commitment
The user/client who accesses the aforementioned services undertakes to comply with the following legal commitments:
a. Be of legal age and have full civil and criminal rights in the country in which he/she resides.
b. Be in full mental capacity to act, including volitional capacity and capacity to adequately understand these General Terms and Conditions for Contracting Services and any other legal clauses of this website required for access to the service.
c. That the information provided is true and functional.
d. That no information will be used, including email addresses linked to the activity of this website, the communications provider, as well as interested third parties, for profit-making purposes, hacking, fraudulent lists or any other illegal activity.
e. That the use of these services will be ethical and in accordance with these General Terms and Conditions for Contracting Services.
Unsubscribe from service
The user/client will be deregistered from the service in the event of prior resignation from the contract or legal termination of the same in accordance with the clauses and agreements agreed therein.

Management of the data provided
The processing of the data provided will comply with the LGPD and, in particular, the exercise of the rights of access, rectification, deletion, opposition, portability, limitation of processing and the right to object to automated decisions (including profiling). The data will never be shared or sold to third-party companies or interested third parties and will be treated in accordance with current applicable legislation.

Conservation of data
Only the data provided during the performance of the services offered that have been contracted will be kept until the execution process has finished. In the case of data provided during the information process on the services offered, these will no longer be kept when the consultation process ends. In both cases, and in the case of the exercise of the user’s rights included in the LGPD, at no time will the Publisher and its legal representatives create lists or databases, not even for commercial purposes, and any record of the data used during the aforementioned processes will be duly deleted. The provisions of the Spanish LGPD will be complied with at all times.
Legitimation
Each and every personal data provided by you as a user will be processed solely and exclusively for the fulfillment of the legal obligations imposed on the activity for which the data have been provided. All data expressly provided by users of this website will be expressly accepted when requesting information, contacting the Agency and its managers, and during the procedure for contracting services, their execution and completion.
Communication of data to third parties
Under no circumstances will personal data be communicated to third parties except under legal or judicial obligation.
Rights of interested parties
In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, any user who has provided personal data for a specific purpose through this website shall have the right to request confirmation of the processing of their data by the person responsible for this website.
